General Terms and Conditions
General Terms and Conditions for participation in package tours organized by DUBTOUR GROUP s.r.o. (hereinafter General Conditions) apply to all package tours, stays and tourism services organized by travel agency DUBTOUR GROUP s.r.o. (hereinafter TC DUBTOUR GROUP). General conditions of TC DUBTOUR GROUP are an inseparable part of the package tour contract. By signing the contract for package tour, the traveler confirms that these conditions are known to him, he acknowledges them and agrees with them.
DEFINITION OF TERMS
1. Travel agency (hereinafter TC DUBTOUR GROUP): DUBTOUR GROUP s.r.o., with registered office Pribinova 17954/10, 811 09 Bratislava - Staré Mesto district registered in the Commercial Register of Bratislava III District Court, file number 170231/B, ID: 55486266.
2. Traveler: natural person, who concludes a package tour contract or to whom tourism services are to be provided based on a concluded package tour contract. All persons on the traveler's side are obliged to fulfill their obligations arising from the contract for package tour jointly and severally.
3. Law: Act No. 170/2018 Z.z. on package tours, connected tourism services, some conditions of doing business in tourism and on amendment and supplement of some laws, effective from 1.1.2019.
4. Durable medium: means that enables the traveler or TC to store information addressed to him in a way that allows their use in the future for a time that corresponds to the purpose of this information, and which allows unchanged reproduction of stored information, especially paper, e-mail, SMS, USB key, CD, DVD, memory card or computer hard drive.
5. Sales place: premises or other space where TC or TC authorized travel agency or travel agent usually carries out its business activity, including website or other means of distance communication that allow conclusion of a contract for package tour without simultaneous physical presence of contracting parties.
6. Parent: legal representative of a child (father, mother) or person authorized by him aged 18 and more years, who is obliged during the package tour to supervise the safety and health of the child (person under 18 years of age), who are also travelers.
7. Child: Under the age of child is understood the age that the child cannot reach on the day of planned return to SR (child under 2 years cannot on the day of arrival to SR reach 2 years, child under 12 years cannot on the day of arrival to SR reach 12 years and so on.).
8. Infant: international term for child from 0 to 2 years who has no right to any services (accommodation and meals) only mandatory surcharges apply.
9. Sales method: TC DUBTOUR GROUP offers its services in an innovative way only in electronic form on its websites www.dubaj.sk and www.edubai.cz, implemented via computer, tablet and mobile. Each potential traveler can choose accommodation facility, air ticket in required period, in number of days/nights as well as relevant additional services and will receive a proposal/calculation of total price including all fees.
10. Air ticket: It is a contract between the traveler and airline. TC acts only as an intermediary between the traveler and airline.
I. Package tour contract
1. Package tour contract is concluded between TC DUBTOUR GROUP and traveler on the basis of properly completed and signed package tour contract confirmed by TC DUBTOUR GROUP or another TC DUBTOUR GROUP authorized travel agency or travel agent, which mediate services of TC DUBTOUR GROUP. A properly completed and signed package tour contract by the traveler within the meaning of the previous sentence is also considered a properly completed and signed package tour contract by his legal representative or authorized representative. Part of the package tour contract are all written documents and information that the traveler receives from TC DUBTOUR GROUP or on the basis of which the traveler concludes the contract, and especially offer generated from TC DUBTOUR GROUP website according to traveler's choice, which contains all necessary information for conclusion of package tour contract including required information from Annex No.1 of Act No.170/2018 Z.z., General Terms and Conditions, important information and written instructions - detailed information about package tour, stay or ordered services, information contained in detail on the website www.dubaj.sk and www.edubai.cz. TC DUBTOUR GROUP reserves the right to state in special written offers different conditions and specifications that take precedence over these general terms and conditions. Written documents and information provided to the traveler by another TC DUBTOUR GROUP authorized person or travel agent who mediates services of TC DUBTOUR GROUP, are not part of the contract if they are in conflict with the description or information about package tour on TC DUBTOUR GROUP website or in other written documents issued by TC DUBTOUR GROUP.
2. Another TC DUBTOUR GROUP authorized travel agency or travel agent who mediates services of TC DUBTOUR GROUP is not authorized to agree with the traveler provisions in the package tour contract or provide traveler with information that conflicts with the description or information about package tour on TC DUBTOUR GROUP website or in other documents.
3. Person who acts on behalf of the traveler, or as a traveler, by signing the package tour contract confirms that he is authorized on the basis of law or power of attorney to conclude package tour contract on behalf of the traveler and that in case of conclusion of contract in favor of another person, this person expressed consent to participate in the package tour. Such person declares, that he has consent to process personal data of this person and that he informed her about conditions of processing according to this contract. Received correspondence necessary for fulfillment of package tour contract will be conducted with person who acts on behalf of the traveler, or as a traveler.
4. TC DUBTOUR GROUP will deliver to the traveler after conclusion of package tour contract immediately a copy of the concluded package tour contract or unambiguously, understandably, definitely formulated and readable confirmation of conclusion of package tour contract on durable medium. If the contract for package tour was concluded with simultaneous physical presence of contracting parties, TC DUBTOUR GROUP will provide to the traveler at his request also a copy of the concluded package tour contract or confirmation of conclusion of package tour contract in written form. If the contract for package tour was concluded outside TC DUBTOUR GROUP sales place, TC DUBTOUR GROUP will provide to the traveler immediately after conclusion of package tour contract a copy of the concluded package tour contract or confirmation of conclusion of package tour contract in written form or with traveler's consent on another durable medium.
II. Package tour price and price change
1. Price for package tour and all services that the traveler ordered or which are included in the package tour (hereinafter "package tour price") is understood as the total price of package tour stated in the package tour contract. If some costs and fees cannot be determined before conclusion of package tour contract, the contract for package tour must contain a notice about types of additional costs that may still be included in the total price of package tour. From discounts provided by TC DUBTOUR GROUP, the traveler is entitled only to those that are valid and meet conditions as of the date of establishment of contractual relationship, when he must also claim them, otherwise his claim to their provision expires. In case of possibility to use several types of discounts, their cumulation is not possible, the traveler can choose the one that is more advantageous for him, unless it is determined or expressly agreed with TC DUBTOUR GROUP otherwise. Contracting parties take note that additional costs and fees that cannot be determined before conclusion of package tour contract and on which the traveler was warned in advance in accordance with the law may still be included in the package tour price.
2. When providing discounts for children, the decisive factor is the age of the child on the last day of the package tour, resp. completion of service consumption.
3. TC DUBTOUR GROUP reserves the right to change the price of the package tour in the event of changes in exchange rates, fuel prices, taxes, fees and other costs that affect the price of the package tour. TC DUBTOUR GROUP will inform the traveler about the price change in writing at least 20 days before the start of the package tour.
III. Cancellation and modification of package tour
1. The traveler has the right to withdraw from the package tour contract at any time before the start of the package tour. In case of withdrawal, the traveler is obliged to pay TC DUBTOUR GROUP cancellation fees according to the following schedule:
- more than 30 days before the start of the package tour: 0% of the package tour price
- 30-15 days before the start of the package tour: 30% of the package tour price
- 14-7 days before the start of the package tour: 50% of the package tour price
- 6-3 days before the start of the package tour: 80% of the package tour price
- less than 3 days before the start of the package tour: 100% of the package tour price
2. TC DUBTOUR GROUP has the right to cancel the package tour in the following cases:
- if the minimum number of participants is not reached (at least 30 days before the start)
- due to force majeure circumstances
- if the traveler does not pay the agreed price within the agreed time
3. In case of cancellation by TC DUBTOUR GROUP, the traveler is entitled to a full refund of the paid amount or an alternative package tour.
IV. Rights and obligations of the traveler
1. The traveler is obliged to:
- provide accurate and complete information when concluding the contract
- pay the agreed price within the agreed time
- comply with the laws and customs of the destination country
- follow the instructions of the tour guide or TC DUBTOUR GROUP representative
- take care of their own safety and the safety of their belongings
2. The traveler has the right to:
- receive all agreed services according to the contract
- file a complaint in case of non-compliance with the contract
- receive compensation for damages caused by TC DUBTOUR GROUP
V. Complaints and dispute resolution
1. The traveler is obliged to report any defects immediately to the service provider and TC DUBTOUR GROUP.
2. Complaints must be submitted in writing to TC DUBTOUR GROUP within 30 days of the end of the package tour.
3. Disputes will be resolved by the competent court in Bratislava, Slovak Republic.
VI. Final provisions
1. These General Terms and Conditions come into force on January 1, 2019.
2. TC DUBTOUR GROUP reserves the right to change these General Terms and Conditions. Changes will be published on the website.
3. If any provision of these General Terms and Conditions becomes invalid, the remaining provisions remain in force.
4. These General Terms and Conditions are governed by the laws of the Slovak Republic.
