General Terms and Conditions for intermediation of individual tourism services
1. These General Terms and Conditions for intermediation of individual tourism services (hereinafter referred to as General Conditions) regulate (i) the conditions under which DUBTOUR GROUP as an Intermediary intermediates the sale of individual tourism services (ii) the procedure for booking individual tourism services and (iii) the conditions for conclusion and formation of the Contract for provision of individual tourism services between the Service Provider and the Interested Party, the subject of which is the provision of individual tourism services by the Service Provider selected by the Interested Party and stated in the booking form under conditions determined by the Service Provider. The rights and obligations of the Intermediary and the Interested Party regulating the intermediation of sale of individual tourism services are governed by these General Conditions and the Reservation. Deviating provisions in the Reservation take precedence over the wording of these General Conditions.
2. The General Conditions of DUBTOUR GROUP are an inseparable part of the Reservation. By accepting the offer of the non-binding form or by contacting DUBTOUR GROUP for the purpose of intermediating individual tourism services, the interested party confirms that these conditions are known to him, acknowledges them and agrees with them.
3. These General Conditions do not apply to the rights and obligations between the Interested Party and the Service Provider when providing individual tourism services according to the Contract for provision of individual tourism services concluded through DUBTOUR GROUP; these relationships are governed by the general terms and conditions of the Service Provider and the Reservation Conditions.
DEFINITION OF TERMS
1. Intermediary: DUBTOUR GROUP s.r.o., with registered office at Pribinova 17954/10, 811 09 Bratislava - Staré Mesto district, registered in the Commercial Register of the Bratislava III District Court, file number 170231/B, ID: 55486266.
2. Interested Party: a natural person who concludes the Intermediary Contract. All other persons who are on the side of the Interested Party are obliged to fulfill their obligations arising from the contract for provision of individual tourism services jointly and severally.
3. Service Provider: a third party, which is a hotel company, airline company or other company, providing the Interested Party with individual tourism services based on a contract, which is intermediated by DUBTOUR GROUP.
4. Durable medium: a means that enables the Interested Party or intermediary to store information addressed to him in a manner enabling their use in the future for a time corresponding to the purpose of this information, and which enables unchanged reproduction of stored information, especially paper, e-mail, SMS, USB key, CD, DVD, memory card or computer hard disk.
5. Intermediary place: premises or other space, where the intermediary usually carries out its business activity, including website or other means of distance communication that enable conclusion of accommodation contract or other contract for provision of individual tourism services without simultaneous physical presence of contracting parties.
6. Method of intermediation: DUBTOUR GROUP offers its services in an innovative way also in electronic form on its websites www.dubaj.sk and www.edubai.cz, implemented via computer, tablet and mobile. Each potential interested party can choose the selection of accommodation facility in the required period, in the number of days/nights as well as relevant additional services and will receive a proposal/calculation of the total price including all fees. DUBTOUR GROUP also offers its services in a traditional way in its brick-and-mortar premises/sales point, and it is possible that services may be provided through a combination of various methods, e.g. through telephone call and subsequent email communication.
7. Reservation: contract between the Interested Party and the Intermediary, on the basis of which DUBTOUR GROUP inter mediates the conclusion of a contract between the Interested Party and the Service Provider.
8. Reservation conditions: conditions under which the Interested Party will use individual tourism services. They contain important information about the hotel and services provided in it, room type, check-in and check-out time, fees payable to the Service Provider and others.
9. Contract for provision of individual tourism services (hereinafter also referred to as "Contract"): contract between the Interested Party and the Provider of individual tourism services, on the basis of which the individual tourism services will be provided to the Interested Party. This may be an accommodation contract, air transport contract or other contract, on the basis of which other individual tourism services are provided to the Interested Party.
10. Group: 10 or more persons for whom individual services are intermediated together.
I. Scope of services provided by DUBTOUR GROUP
1. DUBTOUR GROUP is a company that in the course of its activities acts exclusively as an Intermediary. The subject of DUBTOUR GROUP's activity is intermediation of individual tourism services to the Interested Party.
2. DUBTOUR GROUP inter mediates not only the conclusion of the Contract between the Interested Party and the Service Provider, but also the transactional operation, through which payment of individual tourism services by the Interested Party to the Service Provider occurs.
3. The Contract for provision of individual tourism services is concluded directly between the Service Provider and the Interested Party, DUBTOUR GROUP is not its contracting party. This Contract is governed by the Reservation Conditions and general terms and conditions of the relevant Service Provider.
4. The Interested Party is obliged to familiarize himself with the Reservation Conditions of the relevant Service Provider before concluding the Contract. DUBTOUR GROUP will ensure that the Reservation Conditions of the specific individual tourism services are made available to the Interested Party in a suitable manner and in time, by publishing them on the DUBTOUR GROUP websites for the relevant individual tourism services or by sending them to the email address of the Interested Party. The Reservation Conditions of specific individual tourism services contain provisions regulating the Conditions for cancellation or changes of reservations and possibilities for refund of payments, or other restrictions. DUBTOUR GROUP draws attention to the fact that the Reservation Conditions of specific individual tourism services differ, and therefore it is necessary for the Interested Party to familiarize himself with the Reservation Conditions of each individual tourism service that he wants to use.
5. For the provision of individual tourism services in the scope and quality agreed in the Contract, the relevant Service Provider is exclusively responsible.
II. Non-binding reservation of individual tourism services and Reservation
1. The interested party for intermediation of individual tourism services on the DUBTOUR GROUP websites will fill out a non-binding booking form, in which he will specify the specific individual tourism service, accommodation facility, room type, meal plan and period he is interested in. In the next step, he will fill in information about all travelers and contact details of the person who is the orderer, and then submit the form.
2. The Interested Party may request DUBTOUR GROUP to intermediate individual tourism services in other ways than in point 1, especially through telephone communication, other written communication, or personal communication in the premises of the Intermediary, from which his interest in intermediating individual tourism services clearly follows. DUBTOUR GROUP undertakes to intermediate individual tourism services to the Interested Party by accepting the Interested Party's proposal, and thus at the moment of expressing the will of DUBTOUR GROUP to intermediate for the specific Interested Party individual tourism services, which, like the Interested Party's proposal, does not have to have written form.
After processing the non-binding reservation
3. The non-binding reservation is considered as a proposal for creating a Reservation according to these General Conditions.
4. DUBTOUR GROUP will accept the non-binding reservation – the Interested Party's proposal and confirm its delivery in the shortest possible time from the moment when the non-binding reservation was delivered to DUBTOUR GROUP by the Interested Party.
5. After checking capacities, DUBTOUR GROUP will send an offer to the Interested Party, which the Interested Party can accept. By accepting from the Interested Party's side, the non-binding reservation will be confirmed and the Reservation will be created. The Interested Party, by accepting the offer, confirms that he has familiarized himself with these General Conditions and with the Reservation Conditions of the specific Service Provider and agrees with the rights and obligations contained therein.
6. DUBTOUR GROUP guarantees the offer in the form and scope determined in the offer email only until the precisely defined time stated therein. After this time, the Interested Party may request an extension of validity in writing, by phone or orally. DUBTOUR GROUP will comply with his request according to the current capacities of the Service Provider.
7. In case that the Interested Party is interested in booking individual tourism services for a group, he is obliged to contact DUBTOUR GROUP by phone or in writing. Special Reservation Conditions apply to booking individual tourism services for a group, which DUBTOUR GROUP will inform the interested party about. DUBTOUR GROUP draws attention that the reservation conditions for groups of individual Service Providers may determine different deadlines and payment conditions, or other cancellation conditions.
8. In case that the Interested Party will try to circumvent the Reservation Conditions for groups by dividing his reservation, which would meet the definition of a group, into several smaller reservations, the Service Provider is entitled to charge the Interested Party fees for group accommodation reservation or other fees related to group reservation, which the Interested Party is obliged to pay. DUBTOUR GROUP is not responsible for charging these fees by the Service Provider. DUBTOUR GROUP reserves the right to cancel such reservations that try to circumvent group reservation.
9. If the Interested Party is interested in booking individual tourism services for himself as a legal entity, he has the obligation to announce this fact to DUBTOUR GROUP already in the submitted non-binding form. The same obligation applies to the Interested Party also for announcing whether it is a business trip. If these facts are announced later, they will be considered as a change subject to fee obligation according to Art. XIII fee schedule.
10. For double reservations or reservations that were created with the intention of holding accommodation capacities of one or more Service Providers, DUBTOUR GROUP will first warn the Interested Party and request correction. If the Interested Party does not make the correction, DUBTOUR GROUP reserves the right to cancel such reservations.
III. Intermediation of accommodation and conclusion of accommodation contract
1. After creating the Reservation, DUBTOUR GROUP will send the Interested Party a reservation confirmation and payment details, on the basis of which the Interested Party will pay a deposit for accommodation in the amount determined in the Reservation Conditions and later also pay the remaining part of the accommodation price. At the moment of identification of the credited deposit payment to the DUBTOUR GROUP account, the Interested Party concluded the accommodation contract directly with the accommodation facility.
2. DUBTOUR GROUP guarantees the accommodation price only until the due date of the deposit stated in the payment details. The Interested Party may request DUBTOUR GROUP to extend the due date of the deposit in writing or by phone.
3. If the Interested Party does not pay the deposit or the total amount stated in the payment details by the time that is in the payment details determined as the due date, the Reservation will be automatically cancelled by DUBTOUR GROUP. The Interested Party has no claim for compensation for damages.
4. DUBTOUR GROUP reserves the right not to intermediate the conclusion of the Contract in case that for the accommodation price stated in the payment details it will not be possible to conclude the Contract due to a system error. In such case, DUBTOUR GROUP will immediately return all paid funds to the Interested Party to the account number from which the payment was made or to another account number that the Interested Party will specify.
5. If in the time period from creating the Reservation until paying the deposit there is a change in the service, such as the amount of accommodation price, availability of selected rooms and others, it is necessary for the Interested Party to express consent with such change of the Reservation. If the Interested Party does not express consent with such change, the conclusion and validity and effectiveness of the accommodation contract between the Interested Party and the accommodation facility will not occur. DUBTOUR GROUP will return all paid funds to the Interested Party immediately to the account number from which the payment was made or to another account number that the Interested Party will specify.
6. In case that the Interested Party concluded an accommodation contract and the accommodation price decreases compared to the contractually determined price before using the individual tourism services, this will not be a reason for refund of the deposit.
7. If the Interested Party withdraws from the accommodation contract, he cannot re-book a room in the given accommodation facility at the new reduced price. Accommodation facilities do not accept re-bookings and do not allow intermediation of such accommodation by DUBTOUR GROUP or any other company.
8. If the Interested Party is interested in accommodation during specific periods, such as religious or other holidays, significant sporting events, fairs or conferences, additional fees may be charged to him, even after concluding the Contract. In case that the Interested Party does not agree with the additional fees, DUBTOUR GROUP will set him a deadline by which he can withdraw from the Contract and at the same time all financial funds paid so far will be returned to him.
9. DUBTOUR GROUP draws attention that during specific periods, accommodation facilities may require accommodation reservation for the entire period of holidays, sporting events, fairs or conferences, for which the Interested Party will be informed no later than after creating the Reservation. If the Interested Party books accommodation only for part of such period, the accommodation facility may not confirm such reservation.
10. DUBTOUR GROUP draws attention that special Reservation Conditions apply to specific periods, about which the Interested Party will be informed no later than after creating the Reservation.
11. If the Interested Party has special requirements for accommodation, such as adjacent, connecting, smoking or non-smoking rooms, DUBTOUR GROUP will state this requirement as a note to the Contract. DUBTOUR GROUP does not guarantee fulfillment of special requirements of the Interested Party.
12. DUBTOUR GROUP draws attention that additional fees may apply to fulfillment of special requirements, which need to be paid in advance to DUBTOUR GROUP or directly to the accommodation facility during the stay
13. If the Interested Party wants to extend the accommodation period by additional days, he is obliged to contact DUBTOUR GROUP for this purpose, not to create another consecutive Reservation.
14. The number of persons who want to use the accommodation facility services on the side of the Accommodated Person must correspond to the number of persons for whom the Reservation was made. Otherwise, persons for whom the Reservation was not made may be denied entry to the accommodation facility. In case of not denying entry, such persons will be charged a fee for using individual tourism services according to the accommodation facility conditions, directly by the accommodation facility, which is the Service Provider.
IV. Documents for departure
1. After concluding the accommodation contract, DUBTOUR GROUP will send the Interested Party documents for departure by email, according to the scope of the chosen service, or other additional services. DUBTOUR GROUP will ask the Interested Party to confirm receipt of the documents for departure and the Interested Party is obliged to inform DUBTOUR GROUP about receiving/not receiving the documents for departure.
2. DUBTOUR GROUP will issue a voucher with a reservation number to the Interested Party. The voucher contains besides the reservation number other details of the stay, which are the name of the accommodation facility, room type, number of nights, stay period, meal plan type and others. The voucher must state the number of all accommodated persons. The Interested Party is obliged to check all data stated on the voucher immediately after its issuance. In case of finding incorrect data, he is obliged to inform DUBTOUR GROUP immediately, which will make the correction.
3. The Interested Party, or persons for whom accommodation was booked, present themselves with the voucher at the accommodation facility reception during their accommodation. If they do not present the voucher, or present an invalid voucher, or a voucher containing errors, the accommodation facility may refuse to accommodate these persons. Similarly, it may charge the accommodation price and fees directly to these persons.
4. In case of withdrawal from the accommodation contract, the Interested Party is obliged to return the voucher issued for accommodation that was cancelled to DUBTOUR GROUP. If the Interested Party does not do so, he is responsible for its possible misuse.
V. Accommodation facilities and services provided in them
1. Ratings of accommodation facilities published on the websites www.dubaj.sk and www.edubai.cz or stated in the Reservation confirmation or in the Contract were not performed according to conditions set in and may not be in accordance with the Decree of the Ministry of Economy of the Slovak Republic No. 419/2001 Z.z., which regulates the categorization of accommodation facilities and classification marks for their classification into classes. Ratings of accommodation facilities were performed in accordance with the legal system of the country where the accommodation facility is located.
2. All accommodation schemes that DUBTOUR GROUP states on its websites are based on specifications provided to DUBTOUR GROUP by the accommodation facility. DUBTOUR GROUP draws attention that the accommodation scheme illustration serves only as a general illustration of accommodation and real dimensions, design, equipment or facilities and equipment of the accommodation facility may differ from the scheme stated on the DUBTOUR GROUP websites.
3. Renovation works of various scope may be taking place in accommodation facilities. The accommodation facility will take necessary measures to ensure that renovation works limit its guests as little as possible. Renovation of the accommodation facility is not a reason for refund of the price for individual tourism services.
4. About all renovation works that were announced to DUBTOUR GROUP by the accommodation facility, DUBTOUR GROUP will inform the Interested Party before concluding the Contract. In case that information about renovation works will be provided to DUBTOUR GROUP only after concluding the contract, it will immediately inform the Interested Party about it. The Interested Party is aware that renovation works may take place even when the accommodation facility did not inform DUBTOUR GROUP about it. Even renovation works that the Interested Party did not know about in advance are not a reason for refund of the price for individual tourism services.
5. Most accommodation facilities usually allow accommodation of visitors no earlier than 14:00 local time. In certain countries, the check-in time may be shifted. The Interested Party is obliged to familiarize himself with the check-in time in the Reservation Conditions of the specific accommodation facility.
6. The Interested Party is obliged to arrive at the accommodation facility reception for the purpose of accommodation, at times determined by the accommodation facility, no later than the time determined in the Reservation Conditions.
7. In some countries, rooms for three persons may consist of one larger double bed, and the accommodation facility does not supplement a separate bed for the third person even upon request. Rooms for four persons may be composed of two double beds and the accommodation facility does not have to replace the stated beds with separate beds even upon request.
8. Extra beds, which are provided in most accommodation facilities, do not have standard bed dimensions, but are usually sufficient for an adult person to sleep. In case that the Interested Party booked a shared bed and during the stay requests an extra bed instead and the accommodation facility complies with his request, this may be subject to separate charging, which the client pays directly to the accommodation facility.
9. The accommodation facility may require the Interested Party to provide a credit card for the purposes of covering incidental expenses. If the Interested Party does not have one, the accommodation facility may require a cash deposit from the Interested Party.
10. Any expenses that the Interested Party did not agree in the Contract, or did not pay to DUBTOUR GROUP or caused them only during the stay in the accommodation facility, the Interested Party is obliged to pay directly to the accommodation facility. The accommodation facility will deduct such expenses from the deposit paid on site by the Interested Party or will charge them from the Interested Party's credit card.
11. In case that the Interested Party causes damage in the accommodation facility, he is responsible for it and the amount of damage will be obliged to pay when leaving the accommodation facility.
VI. Intermediation of air tickets
1. Together with the Reservation confirmation, DUBTOUR GROUP will ask the Interested Party to pay the air ticket price to the DUBTOUR GROUP account. After the Interested Party pays the air ticket price, DUBTOUR GROUP will ask the airline to issue the air ticket. After issuing the required air ticket by the airline, DUBTOUR GROUP will send a confirming email with the air ticket number to the Interested Party. At the moment of issuing the air ticket, the Interested Party concluded the Contract directly with the airline.
2. If in the time period from the non-binding air ticket reservation until paying the air ticket price there is a change in the service, such as the amount of the air ticket price, availability of selected seats and others, and if the Interested Party does not express consent with such change, the validity and effectiveness of the Contract between the Interested Party and the airline will not occur and the Interested Party will be refunded the payment for air tickets in full.
3. Change of flight time or air carrier is not a reason for withdrawal from the Contract.
VII. Withdrawal from the Contract and withdrawal fee
1. If the Interested Party decides to withdraw from the Contract, he will announce withdrawal from the Contract to DUBTOUR GROUP, which will issue a withdrawal confirmation to the Interested Party. If this confirmation was not delivered to the Interested Party, he is obliged to inform DUBTOUR GROUP about it.
2. DUBTOUR GROUP draws attention that special withdrawal conditions will apply to withdrawal from the Contract, even partially including specific periods, and will be applied to all reserved nights, including those that do not fall into the specific period.
3. If the Interested Party does not pay the deposit and later also the total amount by the day determined in the payment details, in case that the due date was not extended by DUBTOUR GROUP, DUBTOUR GROUP will automatically cancel the Reservation.
4. In case of withdrawal from the Contract, DUBTOUR GROUP does not return the paid deposit to the Interested Party. If withdrawal from the Contract occurs at the time when the total price of individual tourism services was paid, DUBTOUR GROUP will return the paid financial funds to the Interested Party according to the Reservation Conditions of the specific Service Provider.
5. Withdrawal from the transport contract is governed by the general terms and conditions of the airline. DUBTOUR GROUP draws attention that when withdrawing from the transport contract, paid financial funds are usually not returned to the Interested Party.
VIII. Payment conditions
1. DUBTOUR GROUP has the right to require from the Interested Party before concluding the Contract a deposit in the amount determined according to the Reservation Conditions of the specific Service Provider. The deposit will be credited to the price of individual tourism services. If the Interested Party withdraws from the contract, the deposit is not returned to him.
2. After concluding the Contract, the Interested Party is obliged to pay the remaining price of individual tourism services according to the Reservation Conditions of the relevant Service Provider, to the DUBTOUR GROUP account.
3. If individual tourism services are being intermediated to the Interested Party in the form of an air ticket, the Interested Party is obliged to pay 100% of its price to the DUBTOUR GROUP account when intermediating it. DUBTOUR GROUP will subsequently transfer the paid amount to the Service Provider.
4. The right to provide the intermediated individual tourism services arises for the Interested Party only after paying the full price of individual tourism services to DUBTOUR GROUP and fulfilling other conditions of the Service Provider.
IX. Change of intermediated individual tourism services
1. If the Interested Party wants to make any change in the Contract, he is obliged to turn with this request to DUBTOUR GROUP in sufficient time in advance.
2. DUBTOUR GROUP will process the Interested Party's request for change no later than the next working day after the day when the request was announced to DUBTOUR GROUP.
3. Each change requested by the Interested Party may be charged by DUBTOUR GROUP according to the fee schedule in Art. XIII, and may also be charged by the Service Provider to whom the change relates.
4. A request consisting of extending the use of individual tourism services, announced in sufficient time in advance, will not be subject to charging according to Art. XIII fee schedule. DUBTOUR GROUP.
5. DUBTOUR GROUP will announce the change to the relevant Service Provider only when the Interested Party pays the change fee according to Art. XIII fee schedule and the change fee determined by the Service Provider.
X. Rights and obligations of the Interested Party
1. The basic rights of the Interested Party include:
a) Right to proper intermediation of individual tourism services.
b) Right to proper provision of information related to intermediated individual tourism services and Service Providers that are known to DUBTOUR GROUP.
c) Right to withdraw from the Intermediary Contract at any time even without stating a reason. The Interested Party's right to withdraw from the Contract is governed by the Reservation Conditions.
e) Right to complain about defects, faulty performance and claim claims from individual tourism services has the Interested Party according to Art. X of these conditions.
g) In case of providing personal data of another natural person (person on the Interested Party's side), the Interested Party declares that he has her consent, which he can prove at any time upon request of DUBTOUR GROUP and at the same time informed her about the conditions of processing personal data by DUBTOUR GROUP.
2. The basic obligations of the Interested Party include:
a) Provide DUBTOUR GROUP with cooperation necessary for proper provision of intermediation of individual tourism services, especially providing complete, correct and truthful data when booking individual tourism services and other necessary documents, as well as submitting all relevant materials and documents, which are conditional for providing services. In case of proper non-fulfillment of this obligation, the Interested Party is obliged to pay DUBTOUR GROUP all costs and damage that arose to DUBTOUR GROUP by providing incorrect, incomplete and untruthful data.
b) Report in advance the use of individual tourism services by persons other than citizens of the Slovak Republic, otherwise DUBTOUR GROUP is not responsible for proper provision of intermediation or for intermediating tourism services to these persons.
c) Pay the price of individual tourism services in full according to the Reservation Conditions and prove this fact if necessary;
d) In case of announcement of additional changes from DUBTOUR GROUP regarding intermediation of individual tourism services, announce immediately, no later than the set deadline, in writing, by phone or orally his position to DUBTOUR GROUP.
e) Take over from DUBTOUR GROUP all documents necessary for using individual tourism services and check the correctness of data stated in them
f) In case that the Interested Party finds incorrect data in documents according to Art. X. point 2 letter e), he is obliged to inform DUBTOUR GROUP about it immediately.
g) The Interested Party is obliged to pay the costs of change in the amount determined by the Service Provider of individual tourism services and the change fee of DUBTOUR GROUP in the amount determined according to the type of requested change according to Art. XIII
h) Bear exclusive responsibility for compliance with passport, visa, customs, foreign exchange, transit, health, transport and other regulations of the Slovak Republic as well as regulations, laws and customs of the destination or transit country.
i) The Interested Party is obliged to strictly follow the instructions and information announced by DUBTOUR GROUP or the Service Provider when using individual tourism services, observe times and places of departures and arrive on time for provision of services according to instructions of DUBTOUR GROUP or the Service Provider.
j) The Interested Party is obliged to follow the rules and order of the specific Service Provider during the use of individual tourism services.
XI. Rights and obligations of DUBTOUR GROUP
1. The basic obligations of DUBTOUR GROUP include:
a) DUBTOUR GROUP will provide before concluding the Intermediary Contract all information known to it about the intermediated tourism services and about the Service Provider.
b) DUBTOUR GROUP inter mediates individual tourism services in the manner, scope and quality agreed in the Reservation.
2. The basic rights of DUBTOUR GROUP include:
a) DUBTOUR GROUP reserves the right not to intermediate individual tourism services to the Interested Party in case that the Interested Party does not properly and timely pay the deposit or the total price for individual tourism services in the deadline stated in the payment details, or in accordance with the Reservation Conditions.
b) DUBTOUR GROUP reserves the right not to intermediate the conclusion of the Contract to the Interested Party, in case that the Interested Party's non-binding reservation contains obvious inaccuracies, incorrect or incomplete information and the Interested Party does not remove the stated deficiencies even in an additional deadline.
c) DUBTOUR GROUP reserves the right not to intermediate the conclusion of the Contract to the Interested Party in case that the Interested Party removes all deficiencies of the non-binding reservation, but does so at a time when the individual tourism services are no longer available.
d) DUBTOUR GROUP reserves the right not to intermediate individual tourism services to the Interested Party even when the Interested Party's non-binding reservation clearly does not meet the requirement of seriousness.
e) DUBTOUR GROUP reserves the right not to announce changes in the Interested Party's data to the Service Provider when the Interested Party does not pay the change fees consisting of the fee determined by the Service Provider and the change fee of DUBTOUR GROUP in the amount determined according to the type of requested change according to Art. XIII fee schedule.
XII. Liability for provision of individual tourism services, complaint and compensation for damages
1. DUBTOUR GROUP is not responsible for the provision and level of individual tourism services in any scope.
2. For the provision of individual tourism services in the scope and quality agreed in the Contract, the relevant Service Provider is exclusively responsible.
3. If individual tourism services are not provided in accordance with the Contract or if they do not have properties that the Interested Party reasonably expected with regard to the offer and customs, the Interested Party may, in case of need for complaint related to provision of individual tourism services, turn to the relevant Service Provider.
4. If the Interested Party has a claim for adequate compensation for property damage and a claim for compensation for adequate non-property harm that arose to him as a result of substantial breach of the Contract, he can claim it exclusively from the Service Provider
XIII. Fee schedule
1. DUBTOUR GROUP reserves the right in connection with the Interested Party's request for change or addition to the Reservation or accommodation contract, such as change of period, destination, room type, meal type, accommodation facility, person using individual tourism services or any other change, to perform change or addition to the Reservation or accommodation contract for a fee of 25 EUR per person to whom the change or addition relates.
XIV. Extraordinary measures in connection with COVID-19 disease
1. In connection with the extraordinary situation caused by COVID-19 disease, the Interested Party is obliged to familiarize himself with conditions related to COVID-19 disease valid in the country/at the Service Provider, in which/at which individual tourism services will be provided to him, especially with conditions for entry into the country, entry into the accommodation facility, entry into the aircraft, and possible obligation to prove oneself with a negative COVID-19 PCR test or to undergo testing for COVID-19 disease in the country/at the Service Provider. Upon request of the Interested Party, DUBTOUR GROUP will ensure that the stated conditions are made available to the Interested Party in time so that the Interested Party can familiarize himself with them before concluding the Contract and after concluding the Contract, especially at the time close to using individual tourism services.
2. By concluding the Contract, the Interested Party declares that he is aware that the above-mentioned conditions are determined by state authorities of the specific country and specific Service Providers, that he has fully familiarized himself with them and unreservedly agrees with them and if he does not fulfill them after concluding the Contract or the conditions change by the time of using individual tourism services, this is not a reason for refund of the paid price.
3. Change of epidemiological situation related to COVID-19 disease in the country/at the Service Provider, in which individual tourism services will be provided, is also not a reason for refund of the paid price.
4. Due to the epidemiological situation, the operation of hotel restaurants, bars, swimming pools or water parks may be limited. Similarly, the way of serving meals may be changed. DUBTOUR GROUP cannot influence measures of accommodation facilities that are carried out with the intention of protecting primarily visitors of accommodation facilities. Changes in the operation of accommodation facilities due to the epidemiological situation are continuously updated by DUBTOUR GROUP according to information announced to it.
XV. Personal data protection
1. When processing personal data, DUBTOUR GROUP proceeds in accordance with Regulation (EU) No. 2016/679 of the European Parliament and Council on the protection of natural persons in the processing of personal data and on the free movement of such data, which repeals Directive 95/46/ES (GDPR) and Act No. 18/2018 Z.z. on personal data protection. DUBTOUR GROUP processes personal data that the Interested Party provides to it in connection with concluding and fulfilling the Reservation, the processing of which is necessary for the given purpose. The Interested Party who creates the Reservation declares that he is authorized to provide data about other persons on the Interested Party's side, in whose favor he concludes the Contract. The Interested Party further takes into account that personal data will be provided to other recipients, especially Service Providers for the purpose of ensuring intermediation of conclusion of the Contract, and at the same time may be provided within cross-border flow to third countries under the assumption that providing this data is a necessary condition for realization of ordered services. The Interested Party confirms that he was informed by DUBTOUR GROUP about processing his personal data according to Art. 13 and 14 GDPR as stated in the Personal Data Protection Conditions on the DUBTOUR GROUP website www.dubaj.sk and www.edubai.cz in the "Personal Data Protection" section, or in the Intermediary's premises or at another sales point, and undertakes to provide the stated information to other persons on the Interested Party's side stated in the Contract.
2. The detailed information obligation of DUBTOUR GROUP in relation to personal data protection of affected persons is fulfilled by DUBTOUR GROUP through the website www.dubaj.sk and www.edubai.cz in the "Personal Data Protection" section.
XVI. Final provisions
1. Disputes that may arise from the Intermediary Contract between the contracting parties can be resolved alternatively, through alternative dispute resolution entities (Entities registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic). The Interested Party can exercise his rights and claims also through the European Online Dispute Resolution Platform, which is available online at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=SK
2. The validity of these contractual conditions applies to intermediation services provided by DUBTOUR GROUP, except for cases when DUBTOUR GROUP agrees in advance in writing with the Interested Party on a different scope of mutual rights and obligations.
3. By sending the non-binding reservation to the Intermediary, the Interested Party confirms that before concluding the Intermediary Contract, he familiarized himself with its content as well as with all its parts and unreservedly agrees with it. At the same time, he confirms that he has familiarized himself with and agrees with the content of these General Terms and Conditions and important information and arrangements contained in them.
5. All data and facts contained and received on a durable medium by DUBTOUR GROUP and on the website www.dubaj.sk and www.edubai.cz about services, prices and conditions correspond to information known at the time of the Interested Party's request.
6. These general terms and conditions of DUBTOUR GROUP become effective on November 25, 2020. All data and facts contained in the offer on a durable medium and on the website www.dubaj.sk and www.edubai.cz corrections and changes updates are continuously published on the website www.dubaj.sk and www.edubai.cz and are based on facts and legal status as of the date of their publication.
7. These General Terms and Conditions for intermediation of individual tourism services do not apply to contractual relationships that arise between the traveler and DUBTOUR GROUP from the package tour contract and legal relationships arising therefrom. Relationships between the traveler and DUBTOUR GROUP are governed by the General Terms and Conditions for provision of package tours and related tourism services, which are published HERE.
